41 Concurrent operation of State and Territory laws
This Act is not intended to exclude or limit the operation of a law of a State or Territory to the extent that the law is capable of operating concurrently with this Act.
Without limiting subsection (1), this Act is not intended to exclude or limit the concurrent operation of a State or Territory home buyer scheme law merely because the law relates to a State or Territory home buyer scheme.
This section does not apply to a law of a State or Territory if there is a direct inconsistency between this Act and that law.Note:
Section 42 prevents inconsistencies arising in some cases by limiting the operation of the Help to Buy program.
