8B Priority of local government charge preserved

(1)

This section applies if—

(a)

the chief executive intends to sell land under section 8A; and

(b)

the land is subject to a charge for an overdue rate under the Local Government Act 2009.

(2)

The chief executive must, before selling the land, give written notice to the local government to which the rate is payable stating the chief executive’s intention to sell the land.

(3)

The chief executive may sell the land only—

(a)

subject to the charge; or

(b)

free of the charge to the extent, and subject to any conditions, agreed by the local government to which the rate is payable.
