406N Contract determination fixing minimum remuneration and working conditions for independent couriers

(1)

The commission may, on an application by an entity mentioned in section 406O or its own initiative—

(a)

make a determination (a contract determination) fixing minimum remuneration and working conditions for independent couriers under—

(i)

a class of courier service contracts; or

(ii)

different classes of courier service contracts; or

(b)

make an order varying a contract determination.

Note—

See section 406F for the matters the commission must consider in exercising its powers under this chapter in relation to a contract instrument.

(2)

A contract determination must state the class of courier service contracts, or different classes of courier service contracts, for which the determination operates.

(3)

A contract determination may state that it stops operating on a stated day.

(4)

A class of courier service contracts may be identified by reference to a stated principal contractor.
