406X Notice of intention to be party to negotiations
This section applies if—
a person (the proposer) gives notice under section 406W of the proposer’s intention to start negotiating with a view to making negotiated agreement; and
a person who receives the notice wants to be a party to the negotiations.
The person must give written notice of the person’s intention to be a party to the negotiations to—
the proposer; and
the commission.
A notice under subsection (2) must be given within 21 days after the person receives the proposer’s notice under section 406W.
An agreement proposed to be a negotiated agreement may only be made during the period mentioned in subsection (3) if notice of intention to be a party to the negotiations has been given under subsection (2) by—
each proposed party to the negotiations; and
each relevant employee organisation for the proposed agreement.
