42 Entitlement—employees other than casual employees

(1)

This section does not apply to a casual employee.

(2)

An employee may take up to 10 days of sick leave each year on full pay (carer’s leave) to care for or support—

(a)

a person who is a member of the employee’s immediate family or household—

(i)

when the person is ill; or

(ii)

because an unexpected emergency arises in relation to the person; or

(b)

a person who has experienced domestic violence.

(3)

If the employee has exhausted the entitlement under subsection (2), the employee may take up to an additional 2 days unpaid carer’s leave each time the employee needs to take the leave.

(4)

The employee may take additional unpaid carer’s leave with the employer’s agreement.

(5)

Carer’s leave may be taken for part of a day.

(6)

In this section—

sick leave includes sick leave accrued before the commencement of this section.
