705 Convicted persons—holding office

(1)

This section applies if a person who holds an office for an organisation is convicted of a disqualifying offence.

(2)

The person ceases to hold the office for the organisation 28 days after the conviction unless, within that time, the person makes an application under subdivision 2 for leave to hold the office.

(3)

However, if the person makes an application for leave within that time, the person ceases to hold the office for the organisation—

(a)

3 months after the conviction, if the application has not been decided and the court has not extended that time; or

(b)

if the court has extended that time—at the end of the extended time.

(4)

The court may extend the time only if—

(a)

an application for the extension is made before the time mentioned in subsection (3)(a); or

(b)

if it has previously extended the time—the application for the further extension is made before the end of the time as extended.
