756 Certificate about reporting units—application by organisation
An application by an organisation for a certificate under section 755 must—
be made as prescribed by regulation; and
include an application for the registrar to certify the changes to the organisation’s rules that are required to give effect to the establishment of the proposed reporting units. Examples of the changes that may be required—
• changes to designate officers from the branches of the organisation to be the management committee for the reporting unit to comply with this division
• changes to designate officers from the branches of the organisation to undertake the duties that are necessary to enable the reporting unit to comply with this division
If an organisation applies for a certificate, the registrar must issue the certificate and certify the rule changes if the registrar is satisfied—
the level of financial information that would be available to members under the proposed division into reporting units would be adequate and would be relevant to the members; and
the changes to the rules—
comply with, and are not contrary to, this Act, modern awards or enterprise agreements; and
are not otherwise contrary to law; and
have been made under the organisation’s rules.
