An officer or employee of an organisation who is being investigated by an inspector must assist in and cooperate with the investigation unless the officer or employee has a reasonable excuse.Maximum penalty—100 penalty units.
If an organisation is being investigated by an inspector or audited by a complaints auditor, the organisation must ensure the officers and employees of the organisation assist in and cooperate with the investigation or audit unless the organisation has a reasonable excuse.Maximum penalty—100 penalty units.
For subsection (1), it is a reasonable excuse for an officer or employee of the organisation not to assist in and cooperate with the investigation if doing so might tend to incriminate the officer or employee.
