914 Power to require name and address

(1)

This section applies if an inspector—

(a)

finds a person committing an offence against this Act; or

(b)

finds a person in circumstances that lead the inspector to reasonably suspect the person has just committed an offence against this Act; or

(c)

has information that leads the inspector to reasonably suspect a person has just committed an offence against this Act.

(2)

The inspector may require the person to state the person’s name and residential address.

(3)

The inspector may also require the person to give evidence of the correctness of the stated name or address if, in the circumstances, it would be reasonable to expect the person to—

(a)

be in possession of evidence of the correctness of the stated name or address; or

(b)

otherwise be able to give the evidence.

(4)

When making the requirement, the inspector must warn the person it is an offence not to comply with the requirement, unless the person has a reasonable excuse.

(5)

The inspector may require the person to give evidence of the correctness of the stated name or address if the officer reasonably suspects the stated name or address is false.

(6)

A person must comply with a requirement made to the person under subsection (2) or (3), unless the person has a reasonable excuse.Maximum penalty—40 penalty units.

(7)

A person may not be convicted of an offence under subsection (6) unless the person is found guilty of the offence in relation to which the requirement was made.
