103B Magistrate supervisory role
A magistrate has an overall supervisory responsibility for any committal proceeding coming before a Magistrates Court at a place where the magistrate is appointed to constitute a Magistrates Court.
The supervisory responsibility includes setting timetables for the committal proceeding to the extent not otherwise provided for under an Act or practice direction.
Subsections (1) and (2) do not affect—
the powers of a justice or justices to act in relation to the examination of witnesses in relation to an indictable offence; or
any other power of the court to control a proceeding or of a magistrate to give a direction under section 83A; or
the operation of the provisions of this division relating to registry committals; or
the duty of a magistrate to comply with directions or requirements given or made by the Chief Magistrate.
