148A Admissions of fact
This section applies in relation to a complaint of—
a simple offence, other than a simple offence that is an indictable offence punishable on summary conviction; orNote—See the Criminal Code, section 644 in relation to the admission of a fact on the hearing of a complaint that relates to an indictable offence being heard and decided summarily.
a breach of duty.
On the hearing of the complaint—
the defendant may, personally or by the defendant’s lawyer, admit any fact alleged against the defendant; and
the complainant may, personally or by the complainant’s lawyer, admit any fact relevant to the hearing, but only if the defendant consents to the making of the admission.
An admission of a fact made under subsection (2) is sufficient proof of the fact without other evidence.
