83D Definitions for div 10B

In this division—arresting officer has the same meaning it has in the Criminal Code, chapter 62, chapter division 3.disclosure obligation means the obligation of the prosecution, for the purposes of a relevant proceeding under the Criminal Code, chapter 62, chapter division 3, to comply with the requirements of that chapter division for disclosure to a defendant, other than the obligation to comply with a disclosure direction as defined in the Criminal Code, section 590AV.disclosure obligation direction means a direction under section 83A, to the extent it relates to compliance with a disclosure obligation.party, to a proceeding, includes—

(a)

a defendant who is charged with an offence the subject of the proceeding; and

(b)

the prosecution in relation to an offence the subject of the proceeding.

prosecution has the same meaning it has in the Criminal Code, chapter 62, chapter division 3.
