Specific grounds for refusal

In force

The chief executive may refuse to give the approval if—

(a)

the applicant has made an earlier application for approval to subdivide the existing lease; and

(b)

the earlier application was refused; and

(c)

there is no relevant change in circumstances from the earlier application.
