Application of division

In force

This division applies to land—

(a)

that has been the subject of a lease that—

(i)

has been forfeited; or

(ii)

has been surrendered absolutely; or

(iii)

has expired; or

(b)

that has been the subject of an occupation licence that—

(i)

has been cancelled; or

(ii)

has been surrendered absolutely; or

(c)

that has been set aside as a reserve if—

(i)

the dedication of the reserve has been revoked; and

(ii)

the improvements on the reserve have been made by the trustee of the reserve, or by a person with the trustee’s authority; or

(d)

that has been the subject of a deed of grant in trust if—

(i)

the deed of grant in trust has been cancelled or surrendered absolutely; and

(ii)

the improvements on the land have been made by the trustee or a person with the trustee’s authority.
