Land Act 1994

This section applies if—

for 2 or more related subleases, there are disputes (related disputes) to which this division applies; and

each related dispute is about—

an identical, or substantially similar, term in each related sublease; or

identical, or substantially similar, conduct of the sublessor in relation to each related sublease; and

each related sublessee has complied with subdivision 2 to the extent that subdivision applies to the related sublessee.

The related disputes must be resolved under subdivision 3 or 4 in the same dispute resolution process, by the same mediator or arbitrator, if—

the related sublessees agree to the disputes being resolved in that way; and

the mediator or arbitrator agrees to resolve the disputes in that way.

If subsection (2) applies, a reference to a party to the dispute in section 339D, or subdivision 3 or 4, includes a reference to each related sublessee.
