339H Requirement for mediation before arbitration
(1)
This section applies if—
(a)
the responder does not comply with section 339G(1), (2) or (3); or
(b)
the notifier does not comply with section 339G(5); or
(c)
the parties to the dispute comply with section 339G, to the extent that section applies to each party, and the dispute remains unresolved.
(2)
Unless the parties to the dispute agree otherwise, the parties must attempt to resolve the dispute by mediation before submitting the dispute to arbitration.
