340 Registering a mortgage
(1)
A lease or a sublease may be mortgaged by registering a mortgage.
(2)
If the mortgagor is registered as a trustee, a document stating the details of the trust, or the document creating the trust, must be deposited with the mortgage, unless—
(a)
a document has already been produced for the trust under section 374(2) or deposited under section 375(2) with a transfer; and
(b)
the details of the trust have not since changed.
