431D Instruments, equipment and installations
(1)
An instrument, equipment or installation prescribed under a regulation that is used in accordance with any conditions prescribed under a regulation is taken, in the absence of evidence to the contrary—
(a)
to be accurate and precise; and
(b)
to have been used by an appropriately qualified person.
(2)
A party to the proceeding intending to challenge a matter mentioned in subsection (1)(a) or (b), must give at least 28 days notice of the party’s intention to adduce relevant evidence.
