19 Appointment of acting members

(1)

The Governor in Council may appoint a person to act as a member (other than as president)—

(a)

during any period when a member is absent from duty or can not, for another reason, perform the functions of a member; or

(b)

if the conduct of the business of the court, in the opinion of the Governor in Council, requires the appointment.

(2)

An acting member is appointed on a part-time or full-time basis for the term (not more than 2 years) stated in the member’s instrument of appointment.

(3)

The provisions of this Act applying to members of the court also apply to an acting member to the extent the application is possible.

(4)

The rights of a public service officer appointed as an acting member may be preserved under a regulation.
