41 Residential hardship concession
The Minister may allow a reduction of the rent that would otherwise be payable for a lease (a concession) if the Minister is satisfied—
the lease land is the lessee’s principal place of residence; and
the lessee is suffering hardship; and
either—
the lessee holds, or is entitled to hold, a Commonwealth concession card; or
the annual rent payable under the lease is a significant proportion of the lessee’s taxable income.
If the Minister, after allowing a concession for a lease under subsection (1), considers the financial circumstances of the lessee have changed to the extent the concession should be amended or cancelled, the Minister may change the amount of, or cancel, the concession for future rental periods.
If the Minister allows a concession for a lease under subsection (1) and the lease is transferred, the concession does not apply to the lease from the day of the transfer.
