Land Title Act 1994

This section applies if—

the community management statement for a community titles scheme provides for the progressive subdivision of scheme land; and

under the scheme, the scheme land is to be subdivided by a plan of subdivision to create common property under sections 49B to 49D.

The registration of the plan and recording of the new community management statement for the scheme operate, without anything further, to create the common property.
