Application for costs assessment by law practice giving bill
337 Application for costs assessment by law practice giving bill
A law practice that has given a bill under division 6 may apply for an assessment of the whole or any part of the legal costs to which the bill relates.
If any legal costs have been paid without a bill, the law practice may nevertheless apply for a costs assessment.
The costs application may be made even if any of the legal costs have been paid without a bill.
A costs application may not be made unless at least 30 days have passed since—
the bill was given or the request for payment was made; or
the costs were paid if neither a bill was given nor a request was made; or
a costs application has been made under this division by another person relating to the legal costs.
Subject to this section, a costs application under subsection (1) must be made in the way provided for under the Uniform Civil Procedure Rules.
