Section 22 has effect in relation to the board subject to any restrictions expressly imposed under this or another Act.

Section 22 also has effect in relation to the board subject to any restrictions expressly imposed by—

any relevant strategic or operational plan of the board; and

any relevant directions given to the board under section 23 by the Minister.

The board contravenes this section if it—

exercises a power contrary to a restriction mentioned in subsection (1) or (2); or

does an act otherwise than in pursuance of its functions.

The exercise of the power mentioned in subsection (3)(a), or the act mentioned in subsection (3)(b), is not invalid merely because of the contravention.

An officer of the board who is involved in the contravention contravenes this subsection.

An act of the officer is not invalid merely because, by doing the act, the officer contravenes subsection (5).

The board or officer of the board is not guilty of an offence merely because of the relevant contravention.

In this section—officer, of the board, means—

a member; or

the State librarian; or

an employee of a department or another government entity performing work for the board under a work performance arrangement; or

an employee of the board.
