Urgent suspension
137C Urgent suspension
This section applies if the commissioner believes, on reasonable grounds—
a ground exists for taking disciplinary action in relation to a licence; and
harm may be caused to members of the public if urgent action to suspend the licence is not taken.
The commissioner may immediately suspend the licence (an urgent suspension) by written notice which must—
be given to the licensee; and
state the licence is suspended; and
comply with the tribunal Act, section 157(2).
The urgent suspension takes effect immediately the notice is given to the licensee.
At the same time as the commissioner gives the licensee the notice, the commissioner must give the licensee a notice under section 137(1).
The urgent suspension continues until the first of the following happens—
the commissioner revokes it;
the commissioner, under section 137B(1), gives the licensee notice of the commissioner’s decision under section 137A(1) or (4);
the end of 60 days after the notice under subsection (3) was given to the licensee.
