Review decision
142P Review decision
This section applies to an application under section 142N for review of an original decision.
Unless the commissioner made the original decision personally, the commissioner must ensure the application is not dealt with by—
the person who made the original decision; or
a person in a less senior office than the person who made the original decision.
As soon as practicable after receiving the application, the commissioner must review the original decision and make a decision (the review decision)—
confirming the original decision; or
substituting another decision for the original decision.
The commissioner must make the review decision on the material that led to the original decision and any other material the commissioner considers relevant.
Immediately after making the review decision, the commissioner must give the person written notice of the review decision.
The written notice must comply with the tribunal Act, section 157(2).
