174AA Production or display of identity card
In exercising a power in relation to a person in the person’s presence, an investigator must—
produce the investigator’s identity card for the person’s inspection before exercising the power; or
have the identity card displayed so it is clearly visible to the person when exercising the power.
However, if it is not practicable to comply with subsection (1), the investigator must produce the identity card for the person’s inspection at the first reasonable opportunity.
For subsection (1), an investigator does not exercise a power in relation to a person only because the investigator has entered a place as mentioned in section 176(2)(c) or (d)(i).
Also, subsections (1) and (2) do not apply to an investigator who, after entering a place as mentioned in section 176(2)(c) or (d)(i), exercises a power under section 178(1)(b), (d) or (e) at the place.Example for subsection (4)—An investigator may enter licensed premises while the premises are open for the conduct of business and covertly film a thing in the place.
