Appealing seizure or forfeiture decision
203 Appealing seizure or forfeiture decision
This section applies to a person who must be given an information notice for a decision of the chief executive (a property decision) to seize or forfeit a thing under chapter 5, part 4.
The person may appeal to a Magistrates Court (the court) against the property decision by filing a notice of appeal with the registrar of the court.
The notice of appeal must state fully the grounds of the appeal.
The person must file the notice of appeal within 28 days after an information notice for the decision is given to the person or the person otherwise becomes aware of the decision.
However, the court may, on application and at any time, extend the time for filing the notice of appeal.
The person must serve a copy of the notice of appeal, and any application to extend the time for filing the notice of appeal, on the chief executive.
The appeal does not affect the operation of the property decision or prevent the property decision being implemented.
