256 Existing applications for new interests
This section applies if—
before the commencement, a person applied for an approval, licence or permit (the interest) under the Health Act or the Pest Management Act; and
immediately before the commencement, the person’s application had not been decided.
The person’s application must be decided as if it were—
an application for a substance authority that is equivalent to the interest; and
made under this Act on the commencement.
For subsection (2), if a fee has been paid or waived for the interest, a fee payable under this Act for an application for the substance authority is waived.
