318ELBG Additional criteria for deciding provisions of mining lease
(1)
In making a decision as follows, regard must be had to the prescribed criteria—
(a)
deciding conditions of the mining lease under section 276(1)(o);
(b)
deciding the term of the lease under section 284.
(2)
In this section—
prescribed criteria means all of the following—
(a)
the information statement;
(b)
the assessment criteria;
(c)
any holder submissions;
(d)
the effect of the mining lease on the safe and efficient carrying out of authorised activities for the overlapping tenure;
(e)
for an overlapping permit—the effect of the mining lease on the safe and efficient carrying out of authorised activities for any future lease that may arise from the permit.
