Restrictions on grant of permit to prevent or minimise threat to health or wellbeing
165 Restrictions on grant of permit to prevent or minimise threat to health or wellbeing
This section applies in relation to a damage mitigation permit for a purpose mentioned in section 162(1)(b) for an animal.
The chief executive must not grant the permit unless the chief executive is satisfied—
there is, or may be, a threat to a person’s health or wellbeing resulting from harm caused by the animal to the person; and
action under the permit is unlikely to detrimentally affect the survival of the animal in the wild; and
the proposed way of taking the animal is humane; and
if the animal is a protected reptile—
the reptile would be released into the wild; or
a conservation plan applying to the reptile would authorise a person who holds the permit to keep the reptile.
