77 Noncompliance with stop and desist notice taken to be evidence of fortification
(1)
This section applies if—
(a)
a commissioned officer gives a stop and desist notice to an owner or occupier of premises within 14 days before applying for a fortification removal order for the premises; and
(b)
the notice has not been complied with before the day of the hearing of the application.
(2)
In a proceeding relating to the application for the fortification removal order, evidence that the notice has not been complied with is evidence of the matters mentioned in section 60(1)(a) to (c) unless proven otherwise.
