53D Lease taken to have development plan until decision on whether to approve proposed development plan
(1)
This section applies until—
(a)
if the proposed plan is approved—the holder is given notice of the approval; or
(b)
if approval of the proposed plan is refused—when the refusal takes effect.
Note—For when the decision takes effect, see section 53G.
(2)
Despite the ending of the plan period for the current development plan for the lease—
(a)
the lease is taken to have a development plan; and
(b)
the holder may carry out any authorised activity for the lease.
