Application of div 2

In force

(1)

This division applies if—

(a)

equipment or improvements are taken, constructed or placed on land in the area of a 1923 Act petroleum tenure; and

(b)

the equipment or improvements were taken, constructed or placed on the land for use for an authorised activity for the tenure; and

(c)

the tenure continues in force.

(2)

However, this division—

(a)

does not apply for a pipeline; and

2 For a general provision about ownership while a tenure is in force for a pipeline, see section 79X.

(b)

is subject to part 6O.

(3)

In this section—

equipment includes machinery and plant.

improvements—

(a)

does not include a well, water observation bore or water supply bore; but

(b)

does include any works constructed in connection with the well or bore.
