Stay of operation of other original decision
191 Stay of operation of other original decision
This section applies if, under division 2, an application is made for an internal review of an original decision, other than a seizure decision or forfeiture decision.
Note—
For staying the operation of an original decision, other than a forfeiture decision to which division 2 does not apply, see section 192 and the QCAT Act, section 22(3).
The applicant may immediately apply, as provided under the QCAT Act, to QCAT for a stay of the decision.
QCAT may make an order staying the operation of the original decision to secure the effectiveness of the internal review or any later review by QCAT of the decision.
A stay by QCAT under this section—
may be given on conditions QCAT considers appropriate; and
operates for the period fixed by QCAT; and
may be amended or revoked by QCAT.
The period of a stay by QCAT under this section must not extend past the end of the period within which an application for a review of the internal review decision may be made under the QCAT Act.
