Return of seized document

In force

(1)

The board must return a document seized as evidence, whether by the board or an investigator, to its owner—

(a)

at the end of 6 months; or

(b)

if proceedings involving the document are started within 6 months—at the end of the proceedings and any appeal from the proceedings.

(2)

Despite subsection (1), the board must immediately return the document to its owner if the board stops being satisfied its continued retention as evidence is necessary.
