Professional Engineers Act 2002

This section applies if the board or an investigator damages property when exercising or purporting to exercise a power under division 6 or 7.

The board or investigator must immediately give notice of the damage to the person who appears to the board or investigator to be the owner of the property.

The notice must state—

the particulars of the damage; and

that the person who suffered the damage may be entitled to claim compensation under section 64.

If the board or investigator believes the damage was caused by a latent defect in the property or circumstances beyond the board’s or investigator’s control, the board or investigator may state the belief in the notice.

This section does not apply to damage the board or investigator reasonably believes is trivial.
