43 Use of information obtained under s 40 or 41
Subsection (2) applies to the chief executive in considering information about a person obtained under section 40 or 41.
Information about a conviction of the person may be used only for making a decision as to whether the person is, or continues to be, a suitable person to hold a licence.
Subsection (4) applies to the chief executive in considering information about a person obtained under section 41.
Information about a charge against the person may not be relied on as a basis for making a decision as to whether the person is, or continues to be, a suitable person to hold a licence.
