145 Staying operation of original decision on internal review
The application for an internal review does not stay the original decision.
However, the applicant may immediately apply for a stay of the original decision to QCAT.
QCAT may stay the original decision to secure the effectiveness of the internal review and any later external review by QCAT.
QCAT may stay the operation of the internal review decision on conditions it considers appropriate.
The stay operates for the period decided by QCAT.
The period of the stay must not extend past the time when the decision-maker for the decision makes an internal review decision about the original decision and any later period QCAT allows the applicant to enable the applicant to apply for an external review of the internal review decision.
An internal review application affects the original decision, or carrying out of the decision, only if the decision is stayed.
