Existing commercial activity permit taken to be in force while new application is considered
54 Existing commercial activity permit taken to be in force while new application is considered
This section applies if an application is made under section 49 for a new commercial activity permit intended to commence immediately after an existing commercial activity permit expires.
The existing permit is taken to continue in force from the day it would otherwise have expired until the day on which the earliest of the following happens—
the chief executive grants the new permit;
the chief executive decides to refuse the application and gives the applicant an information notice about the decision;
the applicant is taken to have withdrawn the application under section 56(5);
the existing permit has continued for 3 months after the day it would otherwise have expired.
If the chief executive grants the new permit, it is taken to have commenced immediately after the existing permit would otherwise have expired.
Subsection (2) does not stop the existing permit from being cancelled or suspended under this Act.
