Transfer of easement
153E Transfer of easement
With the Minister’s approval, a strategic infrastructure easement may be transferred to—
for a strategic infrastructure easement for land other than land mentioned in section 153B(2)—
another public utility provider; or
a person approved by the Minister as suitable to provide a public utility service in relation to the strategic infrastructure easement; or
for a strategic infrastructure easement for land mentioned in section 153B(2)—a person, other than a public utility provider, approved by the Governor in Council as suitable to provide infrastructure in relation to the strategic infrastructure easement.
On receiving an instrument evidencing the transfer, the registrar must record the transfer in the appropriate register.
The transfer may be recorded in the appropriate register—
without the approval of a person other than the Minister; and
if the appropriate register is a register under the Land Act 1994—without the approval of the Minister under that Act.
A person approved by the Minister under subsection (1)(a)(ii) is taken to be a public utility provider for the purposes of the strategic infrastructure easement.
In this section—
public utility provider means a public utility provider under—
the Land Act 1994, chapter 6, part 4, division 8; or
the Land Title Act 1994, part 6, division 4.
