Condition about infrastructure charges
84EA Condition about infrastructure charges
A condition imposed under section 84E(1)(a)(i) on an SDA approval for development in a State development area may require the payment of charges to contribute to the costs of infrastructure for the area (infrastructure charges).
The condition—
may apply in relation to infrastructure whether or not the Coordinator-General is responsible for constructing, operating or maintaining the infrastructure; and
may require the infrastructure charges to be paid to an entity, other than the Coordinator-General, who is responsible for constructing, operating or maintaining the infrastructure.
If a condition for the payment of infrastructure charges for infrastructure is imposed on an SDA approval for development in a State development area, no charges for contributing to the costs of the infrastructure may be imposed under the Planning Act in relation to—
the development the subject of the SDA approval; or
development that—
is the natural and ordinary consequence of the development the subject of the SDA approval; or
is otherwise associated with the development the subject of the SDA approval.
Subsection (3) applies despite any other law but is subject to section 85ZF(2).
