Existing request to state later currency period
85S Existing request to state later currency period
This section applies if—
before the cessation, a request to state a later currency period for an SDA approval for the former SDA development has been made, but not decided, under the relevant approved development scheme; and
on the cessation, the SDA approval is taken, under section 85P(2), to be a development approval.
The request must continue to be decided under the relevant approved development scheme as if—
the cessation had not happened; and
the SDA approval were still an SDA approval; and
the request were being decided immediately before the cessation.
If the decision is to state the later currency period, the decision is taken to be a decision under the Planning Act to extend the currency period of the development approval under that Act.
If the decision is to refuse the request, the development approval lapses on the later of the following days—
the day the SDA approval would have lapsed under section 84H if the SDA approval were still an SDA approval;
the day the person who made the request is given notice of the decision under the relevant approved development scheme.
Despite the Planning Act, section 229, a person may not appeal under that Act against the decision on the request.
