Power to require information from local governments
48 Power to require information from local governments
The Coordinator-General may, by written notice given to a local government, require the local government to give to the Coordinator-General, or to a person stated in the notice, information on a particular issue relevant to—
the discharge of the Coordinator-General’s functions or the exercise of powers under this Act; or
the discharge of the local government’s functions or exercise of powers under the Planning Act 2016 or the repealed Sustainable Planning Act 2009.
The notice must state a reasonable period within which the notice is to be complied with and may state the way in which it is to be complied with.
The local government must comply with the notice.
However, the local government may appeal to the Minister against the notice and, if the local government appeals, the local government only has to comply with the notice if, and to the extent that, the Minister directs.
