162 Existing applications for authorities

(1)

This section applies if—

(a)

before the commencement, a person made any of the following applications—

(i)

an application for a licence under the repealed Act, section 6;

(ii)

an application to renew a licence under the repealed Act, section 9;

(iii)

an application for a driver’s certificate or an assistant’s certificate under the repealed Act, section 14;

(iv)

an application to renew a driver’s certificate or an assistant’s certificate under the repealed Act, section 17A; and

(b)

immediately before the commencement, the application had not been decided.

(2)

The application—

(a)

is taken to be a corresponding application; and

(b)

must be decided under this Act.

(3)

Anything done in relation to the application under the repealed Act is taken to have been done in relation to the corresponding application under this Act.

(4)

The chief executive may decide an application mentioned in subsection (1)(a)(ii) or (iv) even if the authority to which the application relates stopped having effect before the commencement.

(5)

In this section—

corresponding application means—

(a)

for an application for a licence made under the repealed Act, section 6—an application for an operator accreditation made under section 17; or

(b)

for an application to renew a licence made under the repealed Act, section 9—a renewal application to renew an operator accreditation made under section 24; or

(c)

for an application for a driver’s certificate made under the repealed Act, section 14—an application for a driver accreditation made under section 17; or

(d)

for an application for an assistant’s certificate made under the repealed Act, section 14—an application for an assistant accreditation made under section 17; or

(e)

for an application to renew a driver’s certificate made under the repealed Act, section 17A—a renewal application to renew a driver accreditation made under section 24; or

(f)

for an application to renew an assistant’s certificate made under the repealed Act, section 17A—a renewal application to renew an assistant accreditation made under section 24.
