52 Conducting tow truck business without operator accreditation

(1)

A person must not conduct a tow truck business unless the person is the holder of an operator accreditation for the business.Maximum penalty—160 penalty units.

(2)

For this section, a person conducts a tow truck business—

(a)

if the person has effective control and management of the business; and

(b)

whether the person conducts the business—

(i)

alone or with another person; or

(ii)

personally or through an agent or employee.

(3)

However, a person does not conduct a tow truck business to the extent the person is engaged solely as a worker in, or an officer of, the business.
