67 Driving to or from private property with passengers

(1)

This section applies if—

(a)

a motor vehicle is parked on private property in a regulated area; and

(b)

the owner of the motor vehicle has not expressly requested or directed the towing of the vehicle from the property; and

(c)

the holder of a driver accreditation attends the private property with a tow truck for the purpose of towing the motor vehicle from the property.

(2)

The holder of the driver accreditation must not drive the tow truck to or from the private property if a person, other than an accepted person, is in the tow truck.Maximum penalty—40 penalty units.

(3)

In this section—

accepted person means—

(a)

the owner of the motor vehicle or the owner’s agent; or

(b)

a person who was the driver of or a passenger in the motor vehicle; or

(c)

the holder of an accreditation; or

(d)

an executive officer of a corporation that is the holder of an operator accreditation; or

(e)

a partner in a partnership that is the holder of an operator accreditation.
