110 Separation and marshalling approvals
The chief executive may, on application under section 166, approve a way of separating goods, or a way of marshalling of rail wagons, not complying with part 9 of the ADG Code for the transporting of dangerous goods and other goods that are incompatible with the dangerous goods, if the chief executive decides—
use of the way would not increase risk; or
it is impracticable to separate the goods or marshal the rail wagons by a way of separation or marshalling stated in the part.
In giving an approval under subsection (1), the chief executive may impose on the approval any condition necessary for the safe transport of dangerous goods.
A person to whom an approval has been given under this section must not contravene a condition of the approval.Maximum penalty for subsection (3)—40 penalty units.
