28 Declaration of non-participating dangerous goods jurisdictions
A State is not a participating dangerous goods jurisdiction if—
the Ministerial Council decides the law of the State does not include provisions having the same, or substantially the same, effect as the model legislation; and
the Minister, by gazette notice, declares the State is not a participating dangerous goods jurisdiction.
In this section—
model legislation means—
the ‘Model Act on the Transport of Dangerous Goods by Road or Rail’, as amended and approved by the Ministerial Council from time to time; and
the ‘Model Subordinate Instrument on the Transport of Dangerous Goods by Road or Rail’, as amended and approved by the Ministerial Council from time to time.
