28B Duty of supervising entity to report suspected offences
This section applies if a supervising entity suspects on reasonable grounds, after performing functions under this Act or otherwise, that a person has committed an offence against this Act.
The supervising entity must—
report the suspected offence to the commissioner of the police service or other appropriate prosecuting authority; and
make available to the commissioner or authority the documents and information relevant to the suspected offence in its possession or under its control.
The obligation under subsection (2)(b) to make available the documents and information continues while the supervising entity holds the relevant suspicion.
