735 Reduction of more than 15%
(1)
This rules applies if, on an assessment of costs payable out of a fund, the amount of professional charges and disbursements is reduced by more than 15%.
(2)
Unless the costs assessor decides otherwise—
(a)
the party with the benefit of the costs order must pay the costs of the assessment; and
(b)
the costs payable under the costs order do not include the costs of preparing the costs statement or attending the costs assessment.
(3)
Subrule (2) applies subject to rules 733, 734 and 736.
